According to the Philippine Star, the Philippine Department of Trade and Industry (DTI, referred to as the Department of Trade and Industry) will issue supplementary guidelines for compulsory certification of vape products next month, requiring all manufactured or imported vape products to be certified, and set this year There is a transition period from June to January 2025. During the transition period, merchants can clear existing non-compliant vape inventories. After the transition period, only certified compliant vapes are allowed to be sold.

Assistant Secretary for Trade Amanda Nograles said at a press conference that a public consultation has been held on supplementary guidelines for technical regulations on compulsory certification of vape products. “We will compile the comments and issue additional guidance next month,” Nograles said.

Mandatory registration and certification of vape products under Republic of the Philippines Act 11900 or the vape Act will take effect in June and a Memorandum Circular (MC) on supplementary guidelines is being issued. This means that before June this year, all vape products manufactured or imported must have a Philippine Standard (PS) mark or an Import Commodity Clearance (ICC) label.

Products with the PS mark or ICC label are products that DTI has determined to meet the relevant Philippine national standards for quality and safety. Likewise, products covered by the compulsory product certification scheme should bear the PS mark or ICC label before being sold in the local market.

Nograles said the upcoming memorandum circular covers supplemental guidance as the DTI has already issued guidance on mandatory product certification of vaporized nicotine and non-nicotine products in 2022 through Department Administrative Order 22-06. Since the order was issued before the vape Act came into effect, she said there was a need to adjust the way certification is done.

Nograles said that there is a transition period from June this year to January 2025, and merchants with existing vape products on the market will be allowed to clear their inventory. “By January 2025, we will enter the market clearance period, and products without the PS mark or ICC mark will no longer be allowed to be sold.”

The Philippine Department of Trade and Industry also sent a letter to the Customs stating that starting from February, it will no longer be allowed to release vape products without a conditional release certificate from the Department of Trade and Industry. The conditional release certificate allows imported products to be transported to the importer’s warehouse where they undergo DTI inspection to ensure that these products comply with product description and packaging regulations.

DTI currently has a testing laboratory in Cavite where it conducts testing of rechargeable batteries, battery chargers, vape devices and heated tobacco products.

Since DTI does not have the facilities to test consumables, Nograles said DTI allows certification by accredited third-party laboratories.
