In recent years, new changes have occurred in the Czech e-cigarette market. Candy-flavored e-cigarettes, known as the “sweet revolution”, have become popular rapidly, especially among young people. Flavors such as marshmallows, donuts, and marshmallow jelly have attracted a large number of young people with their bright and attractive packaging and rich aroma. According to information released by the Czech Ministry of Health, this type of “candy-style” e-cigarettes has become a quick way for minors to get started. Data shows that although the law prohibits sales to people under the age of 18, in the actual purchase process, many stores still fail to strictly implement the age verification mechanism.

In view of the rising trend of teenagers smoking e-cigarettes, the Czech Ministry of Health has drafted an amendment to the decree, deciding to ban the sale of candy-flavored e-cigarettes, focusing on artificial sweet flavors such as marshmallows, donuts, and marshmallow balls. The measure aims to prevent teenagers from trying e-cigarettes because of “tasting sweetness”, thereby reducing the risk of smoking. However, natural flavors such as mint, tea, coffee and fruits (such as strawberries and bananas) are not within the scope of the ban for the time being. This means that in the eyes of parents and regulators, some flavors that are considered less “artificially attractive” can still be used as an option for adults.

Supporters believe that this policy can accurately strike the candy-flavored categories that teenagers are keen on, without completely banning flavors such as fruit and mint, leaving room for adults to choose alternatives to traditional tobacco. But there are also voices of opposition. Robert Hrdlička, a representative of the Czech e-cigarette industry, pointed out that the candy-flavor ban may have limited effect unless age control and law enforcement are stricter. He suggested that the use rate of minors can be truly reduced by increasing the responsibility of retailers and revoking illegal sales licenses.

According to data from health and medical institutions in recent years, about a quarter of young people aged 15 to 24 in the Czech Republic have tried e-cigarettes in 2023, and 15% have been exposed to the product as teenagers. This worries regulators, and the popularity of candy flavors is precisely their focus. Overall, although the use rate of e-cigarettes by adults is mainly concentrated in 8% to 11%, it accounts for a higher proportion among teenagers. How to balance adult use and youth protection has become the core of policy debate.

The Czech approach is not without its own experience. Since the 2016 Tobacco Products Directive, the EU has banned characterizing flavors, allowing only tobacco and mint types, and some member states (such as Finland and Hungary) have even banned all flavors. The UK is also exploring similar measures based on strict analysis of changes in youth usage rates. Studies have shown that sweet flavors are one of the main motivations for minors to start using e-cigarettes. The Czech move is in line with the EU trend, and has both practical basis and international reference significance.

It is easy to draft regulatory texts, but difficult to implement them. The Czech Ministry of Health still needs to submit a revised seal to the European Commission and accept feedback from the public and the industry. Minister Vlastimil Válek admitted that it is not easy to define the boundaries of “candy flavor”, and the linkage interpretation of patterns, names and ingredients is prone to controversy. Before the policy is fully implemented, companies and regulators are worried that it will accidentally hurt adult users or stimulate the expansion of the underground market.

For e-cigarette companies, changes have also changed market strategies. The industry is generally worried that if the ban covers a wide range of flavors, it may reverse the results of many smokers turning to e-cigarettes and push them back to traditional cigarettes. At the same time, many brands have expressed their willingness to cooperate with self-discipline, such as limiting packaging design, clearly marking age limits, and increasing the cost of violations for retailers.

Restricting candy flavors has its own realistic goals, but completely banning flavors or deviating from adult use needs may bring negative consequences: the rise of the black market, smokers abandoning e-cigarettes and returning to cigarettes. Only by accurately cutting off the access path of teenagers and leaving channels for legal, safe, and high-quality brands such as VEEHOO, how to implement supervision, how to carry out publicity, and how to reversely guide consumption – these are the keys to whether Czech policies can be implemented in the future.
