The Canadian Tobacco and Vaping Products Act (TVPA) was amended in 2018 to recognize e-cigarettes as a safer alternative to smoking, while also including measures to protect youth from products through various labelling and promotional restrictions.
“E-cigarettes have helped millions of smokers quit, and if it weren’t for media misrepresentations about the industry and misunderstandings about the product itself, it has the potential to help millions. TVPA public consultation ends April 27
Meanwhile, the TVPA plans to begin its mandated parliamentary review, and the Canadian government has until April 27, 2022, to open a public consultation. However, the TVPA, through Section 30.43, prohibits “anything that may lead people to believe that a health benefit may result from the use of the product or its emissions or by comparing the health effects of the use of the product or its emissions with the health effects of the use of the tobacco product or its emissions. “The purpose of this ban is to prevent the public from being deceived or misled about the health hazards of using vaping products.”
Health Canada’s “List of Claims Used to Promote Vaping Products”
With the submission, the CVA will urge Health Canada to correct the issue, including the associated risk statement, for approved use by licensed specialty vaping shops. In 2018, Health Canada proposed a “List of Claims Used to Promote Vaping Products.” The proposal has been sidelined and languishing in Health Canada’s bureaucracy, undermining the potential public health benefits of smokers switching to e-cigarettes.
“The CVA looks forward to actively participating in the review process and will advocate for enhanced measures to protect youth and increased messaging for smokers about the benefits of switching to e-cigarettes. We encourage all stakeholders to submit feedback,” Tempest said.
